Good

Jurors tend to believe their own eyes rather than the report of an officer. And prosecutors know that. If you look good on a Field Sobriety Test, it is very helpful to your case. Even in cases where you have a breath test over the legal limit, good Field Sobriety Tests can lead to a successful resolution.

 

Bad

Jurors tend to believe their own eyes rather than the report of an officer. And prosecutors know that. Poor performance on Field Sobriety Tests can be difficult to overcome. Some clients have physical limitations that can explain poor performance.  Age, weight and coordination all affect performance. But poor performance on Field Sobriety tests decreases your odds of success. If there is a reason that you performed poorly, let us know and it may be something we can explain away.

 

Did not perform Field Sobriety Tests

If you refused or were not asked to perform Field Sobriety Tests there are no results to be used against you.  The lack of Field Sobriety Tests makes it more difficult for the State to prove a case against you. Refusal to do the Tests may improve your likelihood of a successful resolution.
